Speeding Ticket Dismissed in Lloyd Town Court, Ulster County

The Law Office of Siara Ossa PLLC obtained a dismissal for a client charged with driving 53 mph in a 25 mph zone in the Town of Lloyd, Ulster County. In a notice dated October 7, 2026, Lloyd Town Court confirmed that the speeding charge had been dismissed.

The result followed our motion challenging the Officer’s failure to provide a supporting deposition after a timely written request.

The Charge and Our Response

Our client received a speeding ticket following a traffic stop on State Route 44/55. The ticket alleged a violation of New York Vehicle and Traffic Law § 1180(d).

Our office entered a not guilty plea on the client’s behalf and submitted a written request for a supporting deposition. We followed up with the court, which acknowledged receipt of our notice of appearance.

No supporting deposition had been served on our office or the Client. We prepared a motion to dismiss, supported by the ticket, our written request, and the correspondence documenting receipt.

Why a Supporting Deposition Matters

A supporting deposition provides factual allegations supporting the charge. Under New York Criminal Procedure Law § 100.25(2), a defendant charged by a simplified traffic information is entitled to a supporting deposition upon a timely request.

The requirements matter. Under CPL § 100.40(2), an officer’s failure to provide the deposition within the statutory time, and upon timely request, renders the simplified information insufficient on its face.

Our motion argued that the failure to furnish the requested supporting deposition warranted dismissal of our client’s ticket.

The Outcome: Dismissal

After our motion, Lloyd Town Court issued written confirmation that the charge had been dismissed.

This case illustrates why careful attention to the paperwork and procedural history can matter in traffic defense. Reviewing the ticket, making a timely request, documenting receipt, and following up helped us identify and present a basis for dismissal.
