Ticketed for Driving Without Insurance in New York? Here is What You Need to Know:
A ticket for driving without insurance can have serious consequences for your finances, vehicle registration, and ability to drive. Most drivers are not aware of these consequences because a violation of VTL 319 does not incur points. However, the results from pleading guilty can be far more detrimental than points. Before deciding how to respond, it is important to understand the charge and determine whether your insurance coverage was active when the ticket was issued.

What Insurance Does New York Require?
For most vehicles registered in New York, owners must maintain New York State automobile liability insurance throughout the registration period—even when the vehicle is parked or stored.
The coverage must come from an authorized insurer. Your insurer must also report your coverage electronically to the DMV. An insurance card alone does not complete that reporting requirement. New York DMV insurance requirements
No Insurance or Missing Proof: Why the Difference Matters
A driver who cannot produce an insurance card may still have valid coverage. Be weary that some Officers will not accept screenshots or app related photos of an insurance card as proof of insurance. This is where a majority of these tickets come from and cause unnecessary hassles for drivers. Missing documentation, an insurer’s reporting error, and an actual lapse in coverage are different issues that require careful review.
New York law treats failure to produce an insurance card when required as presumptive evidence of operating without insurance. If your vehicle was insured, documentation confirming coverage on the date of the alleged violation may be important to your defense. Vehicle and Traffic Law § 319
A policy purchased after the stop does not establish that you were insured when the ticket was issued.
The Potential Consequences
A conviction for operating without required insurance can result in a $150 to $1,500 fine, up to 15 days in jail, or both. The statute also provides for a $750 DMV civil penalty. Vehicle and Traffic Law § 319
Your driving privileges may also be affected. According to the DMV, a conviction for driving an uninsured vehicle—or permitting someone else to drive your uninsured vehicle—can lead to revocation of your license or New York driving privilege for at least one year. An uninsured crash can also trigger revocation. New York DMV driver’s manual.
If you are driving someone else’s vehicle and the vehicle is not properly insured, this is usually not an excuse or grounds for the dismissal of the ticket. Most Prosecutors will tell you that it is your responsibility to confirm coverage prior to driving someone else’s vehicle.
What If Your Insurance Lapsed While You Were Not Driving?
Leaving a car parked does not generally eliminate the insurance requirement while its New York registration remains valid. If you intend to cancel coverage without replacing it, the DMV generally requires surrendering the plates before coverage ends. TIP: Drop your plates off at the DMV or mail them with tracking and confirm that the DMV has received them before cancelling coverage on your vehicle.
For certain insurance lapses of 90 days or less, eligible vehicle owners may pay a civil penalty instead of serving a registration suspension. This option has restrictions, including whether it was used within the preceding 36 months. New York DMV insurance Lapse
Steps to Take After Receiving a Ticket
Keep your ticket and gather your policy documents, insurance cards, payment records, and any cancellation or reinstatement notices. Ask your insurer to confirm the precise dates of coverage and whether it properly notified the DMV. Courts will not accept the insurance card with barcode as proof of insurance, as it is impossible to confirm the dates that there was actual coverage. If you are going to Court for a VTL 319 ticket, make sure to be prepared prior to your appearance; Call your insurance company and ask that they provide you a letter, on their letterhead and signed by an Agent, stating that on X date (the date the ticket was issued), coverage was in full force and effect. In a majority of New York Courts, this is the only acceptable proof to dismiss a VTL 319 ticket.
Read all court and DMV correspondence carefully. An insurance ticket and a DMV suspension notice may require separate responses, and obtaining new coverage does not automatically resolve an earlier violation.
