Traffic tickets are very common Upstate New York, especially speeding tickets. Never plead guilty to any ticket received upstate, and call an experienced attorney to handle the matter for you.

Once you retain our office, you do no need to mail in your ticket or appear in Court unless the court explicitly requires your appearance. Some Courts do require drivers to provide their attorney with authorization which is evidence to the Court that the attorney can take a plea or otherwise resolve the matter on your behalf and in your absence.
Once you retain our firm, we send in a notice of appearance to the clerk and plead not guilty on your behalf. We then wait to conference with the prosecutor.
In every case, we seek the most favorable outcome possible. Your case will likely end with a reduction of the original charge and a fine for that reduced charge. Most of the time, the fines are decided by the Judge upon accepting a plea.
We understand that most drivers want their tickets dismissed or reduced to no points. As your lawyers, we want the same thing and have achieved those results in numerous cases. However, we are unable to guarantee or promise a particular result in your case.
The precise outcome of your case will depend on numerous factors related to you, the prosecutor, and the judge. Factors related to you include the specific charge and surrounding circumstances, and your driving history. We treat each case individually and the more we know about you the more effectively we can advocate for you.
We then make an argument to the prosecutor for a reduction or dismissal of your ticket. Each prosecutor and district attorney may have differing policies about which reductions, if any, they may offer. A prosecutor has no obligation to offer any reduction and may choose to force you to plead guilty to the original charge or have a trial. Our job is to convince the prosecutor to offer the best reduction possible.
Once we have a deal with the prosecutor, the judge must approve it. Judges sometimes reject the negotiated plea bargains. If a judge does reject the deal in your case, we will work to find a deal that all parties will accept. Additionally, all fines for any charge are determined by the Court. Having direct communication with your attorney and knowing all the details about yourself and your case is imperative to try to keep the costs as low as possible.
However, most drivers would prefer to pay higher fines if that meant no points at resolution of the matter.
Nearly all of our cases are settled by negotiating a reduction of the original charge to a lower offense with the prosecutor. Traffic trials are very difficult to win, will require your appearance, and are more expensive than the plea bargaining process. Occasionally, the prosecutor will not offer a reduction, and in that case, a trial may be appropriate.
In the event that you took a ticket to trial, any offers previously relayed by the Prosecutor will no longer be available, and you also risk being found guilty of the original charge which can result in increased points on your license, and maximum fines set by the Court.
